The Bonsall family said they had no idea those 30-in diameter underground pipes ran right through their front yard until it was impossible not to see them through gaping holes in their driveway.
“We don’t have enough money to fix this,” said a visibly exasperated Kerry Stavinoha during an interview outside their home last month.
Two sinkholes in less than two years have chewed away at the Stavinohas’ concrete driveway. What once was a flat front yard, now resembles a shallow bowl; a bowl that sinks lower and lower into the earth after every rain.
“It happens all the time,” real estate litigator Steven Blum told NBC 7.
Blum has handled more than a hundred cases across California involving landslides and sinkholes on private property tied to public infrastructure
The soil in San Diego County contains a lot of sand, which can’t withstand water erosion as well as other types of earth, Blum said. That's why he says the soil here is more vulnerable to landslides and sinkholes.
That’s bad news for anyone living near hundreds of similar pipes running under houses and businesses across San Diego County, many of which are beginning to deteriorate from age.

“We’re really frustrated and sad,” Stavinoha said. "We do what we’re supposed to do. We work hard. We pay our taxes.”
Kerry is a nurse and her husband, Aaron, is a U.S. Marine veteran who currently works as an ER physician. Both have been picking up extra shifts, but they said that won’t be enough to pay for the repairs. Last week, the couple met with several banks and is now in the process of taking on a massive amount of debt.
Over the past two years, the Stavinohas said, they’ve spent $100,000 out of pocket toward engineers and specialists to survey the problem and get bids from contractors. They said only one contractor was willing to take on the project at a minimal cost of $650,000. The Stavinohas, who said the bill will cost them their retirement savings, are also using money they had saved to pay for college for their three children. But they said the bulk of the bill will come from a $500,000 home equity loan.
“It’s been a nightmare,” Stavinohas said. “It’s been an absolute nightmare.
Two county storm drains line the uphill road in front of the Stavinoha home. Developer maps obtained by NBC 7 Investigates show those storm drains direct water into a pipe system that runs under the driveway toward their home and then into another pipe which directs all that stormwater down a hill.
When the home was built about 20 years ago, a private developer installed those stormwater pipes. That developer went out of business before the Stavinohas bought and moved into their home.
“We feel like it’s just one family handling this entire community’s water,” said Kerry.
In an email to NBC 7 Investigates, a county spokeswoman confirmed the county is willing to replace the 11 feet of pipe underground between the county storm drain and the Stavinoha front yard. That’s the distance comprising the public right of way.
The first sinkhole appeared in July 2021. Pictures Aaron Stavinoha shared with NBC 7 Investigates show the pipe connected to the county storm drain is so corroded that it no longer appears to have a bottom.
Without a pipe to contain it, nearly 34 cubic feet of water per second pushes out soil, creating pathways below the surface, which washes away more earth every time it rains.
“It’s not even utilizing the pipe,” Kerry Stavinoha explained. “It’s just going straight toward our garage. I mean, massive flow. Like, I don’t think people understand when we had those big rains. It’s like Niagara sound coming through underneath the driveway.”
After more than a year of that, the second pipe, the one designed to redirect water away from their home, gave out. Pictures of that one appear to show a pipe split in half. It’s this pipe that created a 35 foot deep sinkhole near the Stavinoha garage in December 2022.
“We feel that the county really dropped the ball on even trying to see if there was anything to help us,” said Kerry.
In an email, a county spokeswoman argued the government agency is not responsible for the damage, despite the fact the pipes carried county stormwater.
“The connection of a public pipe to a private pipe and draining water from the public pipe to a private pipe is not sufficient to establish county responsibility for the private pipe.
As a public agency, we have to respect private property rights. The idea that if we connect to something, we own it, is incorrect. That concept would limit a property owner’s ability to use that part of their property because county ownership of the infrastructure includes ownership of the land it is on or under.
There could be many different connections to a storm drainage system over miles. Every property owner has an obligation to accept reasonable drainage from their neighbor and pass that drainage on in a reasonable way.
The county is not responsible for infrastructure on private property that it does not own or maintain, even if it connects to sections in the public road right of way.”
“99.9 percent of the time you have to file a lawsuit,” Blum said. “It’s not right. It’s not fair. It’s not what they should be doing ethically. But it’s what they do.”
Blum said in general, the government is responsible for any government structure or infrastructure that causes damage to your private property, even if it isn’t the main cause of the damage.
“There’s an argument to be made that this water is going through a public system,” Blum said. “The Constitution is there to protect you from the government.”
“If anybody is buying a home in San Diego County, I encourage you: research," Kerry said. "Research everything before you buy it, because I think if we had known this, we would not have ever bought this house. If we knew all of the county’s water came under us, we would never have done this.”
It’s not easy figuring out what’s under your home and who’s responsible to fix it. The first thing homeowners should do is look through documents that were part of their home purchase, like title paperwork. That will contain information about property easements that might reveal that there’s a stormwater pipe under your property, who owns it, and who’s responsible for maintaining it.

The Macks' home is equipped with its own vineyard and chapel that the couple rented out as a wedding venue and an Airbnb. But according to a search warrant, the home also doubled as a stash house, for a small fortune in make-up, stolen from major retail stores across the country like Sephora and Ulta.
“This is a top priority for me, primarily because of the safety and security risk it brings to our team," said Ulta Beauty CEO, Dave Kimbell.
Kimbell talked to CNBC’s Courtney Reagan about the investment his company has made in security shelves, as well as security and trauma training, in addition to the wave of theft hitting retail stores.
“The network she built across the country was impacting multiple stores and so by eliminating that, it's a step. But unfortunately, I know there are others out there that are just like that."
Michelle Mack, 53, and her husband have pleaded not guilty to charges of conspiracy, grand theft and receipt of stolen property.
Michelle is accused of working with as many as 12 women, providing them with a list of items to steal from stores across the country. Places like LensCrafters in Clairemont and Ulta Beauty in Mira Mesa.
According to the search warrant the goods were sometimes mailed to a Bonsall post office and ended up for sale, at discounted prices, on an Amazon storefront called "Online Makeup Store."
“We have people that have stolen 54 times. It has become really rampant,” said District Attorney Summer Stephan.
It’s one of the reasons why Stephan and mayors across San Diego County are looking to reform Prop 47.
The ballot measure made some non-violent property crimes under $950 misdemeanors.
Under a new proposal, called the, "Homelessness, Drug Addiction and Theft Reduction Act," prosecutors would be allowed to combine the dollar amount of stolen goods if someone is a repeat offender.
Some city and county leaders are hoping to get enough signatures to put it on the November ballot.
“It will allow us to add those amounts to address the people who are preying on businesses, differently than what the intention was; those first-time youthful offenders that make a mistake.”
Stephan says with online stores and marketplaces becoming the new place for criminals to sell stolen goods, there have been some positive steps toward cracking down.
The recently passed 'Inform Consumers Act' requires online marketplaces to get information from high-volume sellers to help identify stolen goods.
But Stephan says there are still loopholes that need to be closed in some person-to-person marketplaces like Facebook. As well as making sure Prop 47 is reformed so repeat offenders are properly punished.
“It feels like we've decriminalized theft at the expense of these businesses and employees,” said Stephan. “I look forward to a day where the rights of victims and community are balanced with the rights of the criminals. Right now, it's out of balance.”
Amazon released a statement regarding the issue saying:
“We invest more than $ 1 billion annually and employ thousands of people to fight fraud...we use sophisticated detection and prevention solutions."

The historic tallies include 10.1 inches at Palomar Observatory (topping the prior milestone of 9.58 inches, set in 1991); 4.02 in Ramona (2.15, 1995); 3.75 in Campo (2.12, 1954); 3.01 in Vista (2.58, 1980); 2.94 in Alpine (2.6, 1995); 2.68 in Borrego (1.73, 1980); and 1.28 at Oceanside Harbor (1.03, 1980).

Heavy rainfall and driving winds lashed San Diego County today, prompting widespread flooding, fallen trees, mudslides and other storm-related hazards across the soaked region. One report indicated that Fallbrook had received more than 4.6 inches of rain today alone.
All that water wreaked havoc on Fallbrook, Bonsall, and Rainbow today and forced the closure Vallecitos Elementary School and Fallbrook Union High School District schools - Fallbrook High, Ivy High, and Oasis High - were dismissed at 12 p.m. The district announced that because of the President's Day holidays, students won't return until Tuesday.
Bonsall Unified School District schools remained on normal early dismissal time, as did all Fallbrook Unified Elementary School District schools. Those school districts will be closed on Friday, Feb. 15.
"Due to the intense storm – which has led to power outages, flooding, road closures, and dangerous travel conditions – schools in the following districts will be closed tomorrow, Feb. 15," a statement made by the San Diego County Department of Education read.
There were reports of horses being stranded and in need of evacuation in Bonsall, and travel from Fallbrook to De Luz was halted with road closures due to flooded roadways.
The San Diego County Department of Public works reported that Couser Canyon is closed at Pala Loma and Highway 76 due to flooding.
A video shared with the Village News by resident Chad Lansberry showed the amount of water flowing through the Santa Margarita River causing closed roads throughout the area.

FALLBROOK - The heaviest rainfall from a powerful storm system is beginning to have an effect on the Fallbrook, Bonsall, and Pala area this morning and a flash flood watch is in effect until this evening.
Trees are being reported as downed all over Fallbrook and Bonsall and flooding, reported at Vallecitos Elementary School in Rainbow and slick roads may have contributed to the crash of a fire engine that crashed into a ditch early this morning, sending three firefighters to the hospital.
According to several news outlets and CalFire San Diego, the fire engine, Deer Springs Fire Department Engine 11, was on its side in the ditch at N. Old Highway 395 and Camino Del Rey. The firefighters were taken a hospital to be evaluated for non-life threating injuries.
David Toney was generating a list of road closures and warnings for the Bonsall area sourced from the California Highway Patrol incident list and posting them for residents in the Facebook group, Friends of Bonsall.
According to authorities, flooding and debris was reported at:
- W. Dougherty Street and De Luz Road due to flooding
- Sandia Creek Drive and De Luz Road due to flooding
- 1077 S Mission Road due to flooding
- Via Del Robles and Gird Road due to flooding
- De Luz Murrieta Road to the county line, due to flooding
- Circle R Drive and Old Highway 395 due to mud, rock
- Brandon Road and East Mission Road due to flooding as are the intersections of E. Mission with Iowa Street and Santa Margarita Drive.
The NWS issued a flash flood watch that will remain until this evening throughout the county. A wind advisory will remain in effect in the county mountains until 4 a.m. Saturday.
Rainfall rates today are expected to reach 0.50 to 1 inch per hour everywhere except desert areas during the peak of the storm, which will last from about 6 a.m. to 2 p.m., and could be higher than that during isolated thunderstorms, NWS meteorologist Miguel Miller said.
Moderate flooding is expected during the same period for the Santa Margarita River near Camp Pendleton.
In a 24-hour period ending around 3 a.m. today, the highest precipitation tallies included 3.44 inches at Birch Hill; 3.12 in the Palomar area; 2.05 in Fallbrook; 1.75 in Oceanside; 1.65 in Pine Valley; 1.54 in Julian; 1.48 in Valley Center; 1.40 in Harbison Canyon 1.33 in Santa Ysabel; 1.28 at Mount Laguna; 1.1 in Carlsbad; 1.08 in Escondido; 1.05 in Ramona; 1.03 in Santee; 0.99 in Encinitas; 0.81 in La Mesa and Solana Beach; 0.74 near Poway and Fashion Valley; 0.59 at Montgomery Field and the Tijuana Estuary; 0.54 at Brown Field; and 0.51 at Lindbergh Field and San Ysidro, according to the weather service.
The highest precipitation total for the deserts were San Felipe, with 0.75 of an inch, 0.45 in Borrego Palm Canyon and 0.34 near Coyote Creek.
Coastal and inland-valley areas are expected to get anywhere between 1.5 to 2.3 inches of rainfall today while the mountains are forecast to receive between 5.5 and 7 inches of rainfall and between 1 and 3 inches is expected in the county deserts, forecasters said.
Snow levels will remain above 8,000 feet during the day, then drop to around 6,000 feet tonight, Miller said.
South-to-southwest winds of 25 to 35 mph, with gusts reaching 55 mph, are expected late this afternoon through this evening, according to the NWS.
The most steady and intense rain is expected this morning through early this afternoon. Then the storm will die down by this evening, Miller said.
A chance of scattered showers will return Friday evening and remain through Monday afternoon, the meteorologist said.

Recovery assistance for fire victims
SAN DIEGO (KGTV) - The Lilac Fire has ravaged San Diego's North County, prompting thousands of evacuations and leaving scorched destruction in its path.
The blaze began just before 11:30 a.m. off Interstate 15 and State Route 76 in the Bonsall area on Thursday. What started as a 10-acre brush fire exploded into a blaze that spread hundreds of acres within a couple of hours, soon engulfing homes.
WHAT WE KNOW
Acres & containment: 4,100 acres, 75% contained as of 7 p.m. Dec. 10. Firefighters expect full containment by Dec. 21.
Injuries: At least six injuries reported. Three citizens suffered non-life threatening burn injuries, while another was treated for smoke inhalation. Meanwhile, one firefighter suffered a dislocated shoulder but reset his arm and continued to work. Another firefighter was hospitalized for smoke inhalation.
Damages: 151 structures destroyed, 56 damaged. Officials say at least 1,500 structures are still being threatened.
Evacuation centers: The center at Palomar College remains open for victims of the Lilac Fire. However, the center at Bostonia Park & Recreation Center will be closed as of Dec. 11.

Personnel: 1,659 total personnel are assisting.
Equipment: 140 fire engines, 11 helicopters, 29 water tenders, 17 dozers, 33 hand crews.
GOVERNMENT ASSISTANCE
Gov. Jerry Brown issued an emergency proclamation for San Diego County due to the Lilac Fire. The declaration frees San Diego up to use state and federal resources to battle the blaze.
President Trump approved the state's emergency declaration to help in the Southern California wildfire relief effort. FEMA also approved federal resources to help fight the fire.

"The region is being tested in a big way," County Board of Supervisors Chairwoman Dianne Jacob said. "The good thing is, we have more resources than ever before ... we're better prepared and have better cooperation than there's ever been in San Diego County."
Residents near the fire should not wait for a mandatory evacuation order or a knock on the door from law enforcement, Sheriff William D. Gore said. They should rely on common sense and leave their homes if they feel they are in danger, he said.
